Welcome to Beleef-Orania.co.za. These Terms and Conditions govern your access to and use of the website, services, accounts, listings, subscriptions, and any content or features made available through the Platform. By using the Platform in any capacity—including as a visitor, registered user, or Listing Owner—you agree to be legally bound by these Terms and by our Privacy Policy.
If you do not agree with these Terms, you must discontinue use of the website and any services offered.
1. Overview of Our Services
Beleef-Orania.co.za is a South African–based local business directory for the town of Orania. The Platform allows:
- User account registration
- Automatic assignment of the “Guest” role upon signup
- Guests to request Listing Owner status via a verification form
- Approved Listing Owners to purchase a monthly subscription tier
- Listing Owners to create and manage business listings based on their subscription package
- Guests to browse listings, view contact details, and reach out to businesses directly
We serve as a digital intermediary connecting Guests and Listing Owners. We do not host payable bookings or handle service-related payments (except for subscription fees).
2. Definitions
“We”, “us”, “our”: Operators of Beleef-Orania.co.za
“Platform”: The website, features, and systems of Beleef-Orania.co.za
“User”: Any individual who accesses or uses the Platform
“Guest”: A User with a registered account who has not yet been approved as a Listing Owner
“Listing Owner”: A User approved to create and manage business listings on the Platform
“Subscription”: A recurring monthly plan that entitles a Listing Owner to create a fixed number of listings, depending on the chosen tier
“Package”: The specific subscription level a Listing Owner selects, defining how many active listings they may maintain
3. Account Registration and User Roles
All new Users are automatically assigned the Guest role. As a Guest, you may:
- Browse and search business listings
- View contact information for listed businesses
- Send inquiries or booking requests off-platform
Guests may apply to become Listing Owners by completing the verification form. Approval is subject to our review, and we reserve the right to deny or revoke Listing Owner status at any time.
Users must:
- Be at least 18 years old
- Submit true, complete, and current information
- Use strong passwords and safeguard account access
- Notify us immediately of any unauthorized activity
We may suspend or delete accounts for any breach of these Terms.
4. Listing Owner Application & Verification
To become a Listing Owner, you must submit:
- Valid identity documentation
- Proof of business registration (if applicable)
- Address verification documents
- Business description, images, and contact details
We review all applications manually. Submission does not guarantee approval. We may verify information through third-party checks and request additional documentation as needed.
5. Subscription Packages & Listings
Listing Owners must maintain an active subscription to publish and manage listings. Key points:
- Subscriptions renew automatically each month until canceled
- Each subscription tier permits a set number of active listings (e.g., Basic: 1 listing; Standard: 3 listings; Premium: 5 listings)
- You may upgrade or downgrade your package at any time; changes apply at the next billing cycle
- If you exceed your listing limit, you must delete or archive existing listings before creating new ones
- All payments for subscriptions are processed securely via our chosen payment provider
- Failure to pay subscription fees will result in suspension of your listings and dashboard access
6. Content Submission & Platform Use
Listing Owners are responsible for all content they publish, including:
- Business names and descriptions
- Photos, pricing information, and service details
- Availability schedules or operating hours
- Refund or cancellation policies (if offered)
You agree not to upload or distribute:
- False or misleading information
- Content infringing intellectual property rights
- Malware, spam, or harmful scripts
- Defamatory, discriminatory, or inappropriate material
We reserve the right to remove or suspend any content at our sole discretion.
7. Communication & Off-Platform Transactions
Guests may contact Listing Owners directly via the contact details provided in each listing. All negotiations, bookings, and payments for services or products occur outside of Beleef-Orania.co.za. We do not:
- Process or hold any funds related to service bookings
- Guarantee delivery, quality, or performance of any listed services
8. Subscription Cancellation & Refund Policies
Listing Owners may cancel their subscription at any time via the dashboard.
Cancellation takes effect at the end of the current billing period; you retain access to your listings until then.
We do not offer pro-rated refunds for partial months. Refund requests must be submitted via email within seven days of the most recent payment.
9. Dispute Resolution Between Users
We are not a party to contracts between Guests and Listing Owners. While we may facilitate communication, we are not liable for:
- Quality or delivery of services
- Disagreements over bookings or payments
- Any damages arising from off-platform interactions
Users are encouraged to resolve disputes directly and professionally. Repeated abuse may lead to account suspension.
10. Fees & Taxes
Subscription prices are displayed in ZAR and inclusive of applicable VAT.
Listing Owners are responsible for any income tax or other statutory obligations arising from subscription costs.
We do not provide tax or legal advice; consult a qualified professional if needed.
11. Platform Availability & Changes
We strive for 24/7 uptime but do not guarantee uninterrupted access. We may:
- Conduct maintenance or updates
- Modify, add, or remove features
- Temporarily suspend the service
We are not liable for downtime or technical issues.
12. Prohibited Conduct
You may not:
- Use the Platform for unlawful or fraudulent activity
- Harass, abuse, or threaten others
- Circumvent subscription billing or misuse dashboard features
- Upload viruses, spam, or phishing content
- Post false reviews or manipulate listings
- Attempt unauthorized access to data or systems
Violations may result in immediate termination, legal action, or reporting to authorities.
13. Data Protection & Privacy
We comply with:
- South Africa’s POPIA (Protection of Personal Information Act)
- The EU’s GDPR where applicable
We collect, store, and use your data solely for account management, verification, billing, and communication. Please refer to our Privacy Policy for full details.
14. Intellectual Property
Unless otherwise stated:
- All Platform content (excluding user submissions) is owned by us
- Users may not copy, reproduce, or scrape our code, structure, or database
- Listing Owners retain rights to their uploads but grant us a license to use and display them
15. Disclaimers & Limitations of Liability
Beleef-Orania.co.za is a neutral directory. We do not control the services listed and are not liable for:
- Any loss or damages arising from listings
- Misconduct or negligence of Listings or Guests
- Downtime, errors, or data loss
Our total liability for any transaction or dispute shall not exceed the amount paid to us in the prior twelve months.
16. Indemnity
You agree to indemnify and hold harmless Beleef-Orania, its owners, staff, and affiliates from all claims, damages, losses, and legal costs resulting from:
- Breach of these Terms
- Use or misuse of the Platform
- User-submitted content
- Violation of any laws
17. Termination of Use
We may suspend or delete any account or listing, with or without notice, if we believe you:
- Have breached these Terms
- Submitted fraudulent or misleading information
- Engaged in harmful behavior
- Pose a reputational or legal risk
Users may close their account via email or dashboard settings. Outstanding obligations remain enforceable after termination.
18. Third-Party Services & Links
We integrate with services such as payment gateways, mapping tools, and social media plugins. We are not liable for the availability, functionality, or policies of these external services. Review their terms before use.
19. Force Majeure & Notice
We are not responsible for delays or failures due to events beyond our control, including power outages, natural disasters, strikes, or server failures. In the event of a force majeure, the affected party will give prompt written notice to the other, describing the event and its expected duration.
20. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be submitted to the jurisdiction of the Free State High Court, unless an alternative resolution process is agreed in writing.
21. Amendments to Terms
We may update these Terms periodically. The “Last Updated” date will reflect the most recent revision. Continued use of the Platform constitutes acceptance of any modified Terms.
22. Entire Agreement, Severability & Waiver
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Platform. If any provision is held unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right under these Terms does not constitute a waiver of that right.
23. Notices & Electronic Communications
You agree that we may provide notices and communications to you electronically (by email to your registered address). All legal notices to us must be sent to navrae@beleef-orania.co.za. Notice is deemed delivered 24 hours after sending.
24. Price Changes & Payment Failures
We may adjust subscription fees or package terms at any time, but will notify you via email at least 30 days before changes take effect. If a payment fails, we will retry within 48 hours and notify you; unresolved failures may lead to suspension after a 7-day grace period.
25. Dispute Resolution
Before resorting to court, parties agree to attempt good-faith mediation in Orania. If mediation fails within 30 days, either party may pursue litigation in the Free State High Court.
